The Deed

The DeedKnow all men by these present that I, Joseph Fisher of Franklin, Massachusetts, housewright in consideration of the sum of fifteen hundred dollars paid by Maxcy Fisher of the same Franklin, Shoemaker, and of a bond by him given bearing even date with these presents the receipt whereof I do hereby acknowledge do hereby give, grant, sell, convey and confirm unto the said Maxcy Fisher his heirs and assigns forever three fifths of all my cows, oxen, horse and swine and of all my other livestock of every description which I now possess in common and undivided, three fifths of all my husbandry tools of every description, three fifths of all my lands lying in said Franklin, my barn and all my other out-houses and their concomitant appendages. The easterly lower room in my dwelling house, the cellar under the same, the bedroom adjoining. All the easterly new building adjoining the aforesaid room the cellar under the same a privilege is hereby reserved in the house and wood houses equal shares with myself in all my chambers, door entry, and well of water; said lands including several lots and are bounded as followeth viz. the homestead lot containing sixty acres the same more or less bounded westerly on a road leading from Pelatiah Fisher Esq. to David Hartshorn Esq. southerly on land of said P. Fisher southeasterly on land of said P. Fisher, Abijah Allen and Thaddeus Adams, easterly upon the road leading form Joseph Hill’s to the aforesaid D. Hartshorn northerly on land of the aforesaid T. Adams to the first mentioned bounds. Also one other piece of meadowland lying on Mine Brook bounded westerly on a ditch southerly on land of Jesse Ware, easterly and northerly on the brook aforesaid, said lot containing two acres more or less. Also one other piece of meadow land on said brook containing two acres more or less bounded northerly and westerly on said Mine Brook, southerly on land of Oliver Pond and southeasterly on Spring Brook so called.

To have and to hold the afore granted premises with the privileges and appurtenances thereof to him the said Maxcy Fisher, his heirs and assigns forever to his and their use and behoof forever. And I the said Joseph Fisher for myself, my heirs executors and administrators do covenant with the said Maxcy Fisher his heirs and assigns that I am lawfully seized in fee of the aforesaid premises that they are free of all encumbrances that I have good right to sell and convey the same to the said Maxcy to hold as aforesaid and that I will warrant and defend the same to the said Maxcy his heirs and assigns forever against the lawful claims and demands of all persons.

In witness whereof I have hereunto set my hand and seal this fifteenth day of February in the year of our Lord one thousand eight hundred and ten. Susa, my wife of the said Joseph Fisher in token of her right of dower in the foregoing premises has hereunto set her hand and seal the day and year abovementioned.

Signed, sealed and delivered in presence of us Elihu Pond, Alexander Hayden. Norfolk ss. February 19, 1810. Then the abovementioned Joseph Fisher and Susa his wife acknowledged the foregoing instrument to be their free act, before me Elihu Pond Jus. Peace June 17, 1841.
